Welcome

Welcome! I will try and keep this blog updated by posting a tip a week to two weeks in how I managed to study law full-time as well work full-time.  And not just working full-time but running a very busy multi-million $ business.  I also have a small family. Here is my first tip for studying law in Brisbane.  Or anywhere else for that matter.   1.  Give up drinking. You will find that going through a law degree sober is a hell of a lot easier then hung-over.  I did an IT degree back in the late 80s and I think I was pretty much hung-over and tired for the whole of that. I'm not saying it will improve your grades, and it might, but things are a lot easier when you are not tired or stress. Ok, well that was my first welcome post and my first great tip for being a totally responsible law student in Brisbane!

Intellectual Property - Trade Practices - The Law of Passing Off

The principle behind the tort of “passing off” is that a person cannot represent their goods or services as those of another. The action for passing off protects business goodwill and reputation from wrongful appropriation. An action for passing requires the plaintiff to adduce evidence of the following: Goodwill or reputation in a specific industry or trade; A misrepresentation by the defendant of a connection between the defendant or the defendant’s goods or services or business and the plaintiff or the plaintiff’s business; and Damage or threat of damage. Goodwill Goodwill is an intangible property right that does not have an independent existence separate from the business to which it is attached. The plaintiff will not succeed in a passing off action unless he or she can establish distinctiveness of the indicia in question by showing that consumers identify those indicia with its goods, services or business. In order to succeed in an action in passing off, the plaintiff must est

Instructions for Brisbane clients requiring barristers

Law Student Template for Instructions Still, if they try to suggest that you misled them about their options and the probable consequences, your side instructions will protect you. They're proof that you provided all the necessary advice about your client's rights and options in relation to their call. So What would you include inside? Instructions for a local court? Well, true, it is. Many practitioners, I guess, just get their client to sign the first page of the faction under a shorts. Feel about having read the fax and agree to them and acknowledging the type of penalty like to receive. This is useful to do before entering a plea if you press the time and it can suffice if you please someone up, get him sentenced on the same day, particularly if they're in custody in the cells. Especially there's nothing particularly contentious about facts or the play. But if the sentence is going to go over for another day or for centre assessment report or for other subjective ma

About

About me Hi, i'm a law student in Brisbane and without getting to involved I wanted to start a blog for brisbane law students, or any student really on some tips and tricks I have with respects to studying law. I love cricket, going to the courts, particularly Brisbane district courts and watching the lawyers in action. Please note, I do not post notes up here, rather some study tricks I have learnt along the way with respect to using 30 years of IT hacks. Likes I love cricket.  I have a net and a bowling machine in my back-yard and I practice every morning for about 20 minutes. I also love visiting the Albion Cricket Centre to practice there sometimes on a Friday night for an hour and go up against the better bowling machines that they have.
